This Electronic Signature & Electronic Delivery Consent ("Consent") explains how Auth Hero, Inc. ("Auth Hero," "we," "our," or "us") will use electronic signatures and provide records electronically when you use our websites, web and mobile applications, and related services (collectively, the "Services"). By creating an account, accepting an invitation, or clicking a button labeled "I Agree," "Sign," "Accept," or similar, you agree to this Consent.
Auth Hero is not an electronic medical record (EMR) and does not provide medical care. In many cases we act as a Business Associate to Covered Entities (e.g., clinics) under HIPAA. This Consent covers your interactions with Auth Hero. Certain clinical or legal documents may also be governed by your clinic's policies and the clinic's Notice of Privacy Practices.
By using the Services, you agree that your electronic signature—such as clicking to accept, typing your name, drawing your signature, checking a box, replying "I agree" where we permit, or otherwise taking an action that is intended to sign—(collectively, "E-Signature") is the legal equivalent of your handwritten signature for all purposes permitted by applicable law, including the U.S. ESIGN Act and California's Uniform Electronic Transactions Act (UETA). You agree no certification authority or third-party verification is required for your E-Signature to be valid and enforceable.
If you sign on behalf of an organization, you represent that you are authorized to do so and that your E-Signature binds that organization to applicable terms.
You consent to receive Electronic Communications from Auth Hero through the Services and via email or in-product notifications. Electronic Communications include, for example:
You agree these electronic records satisfy any legal requirement that such communications be in writing and that you can print or save copies for your records.
Note on HIPAA/medical notices: When Auth Hero processes PHI on behalf of a clinic, the clinic is generally responsible for clinical notices and consents under HIPAA. This Consent covers how Auth Hero presents and captures signatures/records electronically; it does not change your clinic's obligations or your rights under HIPAA.
You may request a paper copy of any Electronic Communication that we store. We may charge a reasonable fee to cover printing and mailing. To request a paper copy, contact support@authhero.com (subject: "Paper Copy Request") and include your full name, the document title (if known), and the date or approximate date of the record. Paper delivery may take additional time.
You may withdraw your consent to receive records electronically and/or to use electronic signatures at any time by emailing support@authhero.com (subject: "Withdraw E-Sign/E-Delivery Consent"). We will confirm receipt and explain next steps.
Withdrawing consent may limit or terminate your ability to use parts of the Services that rely on electronic signature or electronic document exchange. Certain legal or regulatory records may still be provided electronically where permitted or required by law, or via your clinic's chosen process.
You must maintain a valid email address and keep your account information accurate so we can deliver Electronic Communications. You can update your email in your account settings. If emails bounce or your address is invalid, Electronic Communications may still be considered delivered if they are made available within your account.
To access, view, and retain Electronic Communications, you need:
You are responsible for the setup, maintenance, and operation of your devices and software. Auth Hero is not responsible for errors resulting from your equipment, software, or internet connection.
If you opt in to receive SMS reminders or access links, message and data rates may apply. You can opt out at any time by following the instructions in the message or contacting support@authhero.com. SMS is used for convenience only; the authoritative record remains available in your Auth Hero account or by email.
This Consent applies to all interactions with Auth Hero through which we provide Electronic Communications or request E-Signatures, including new features added over time. Your consent remains in effect until you withdraw it as described above or your account is closed and all legal retention periods have expired.
Auth Hero maintains audit logs and retains records for HIPAA baseline periods (6+ years) or longer if required by law, by our Business Associate Agreements with clinics, or by a customer's documented retention policy. You should also download or print any records you wish to keep for your own files.
This Consent supplements and, where permitted by law, controls over conflicting terms in other Auth Hero agreements regarding the method of signature and delivery (except where a specific feature requires different technical specifications, in which case that feature's specifications control). Your use of the Services also remains subject to the Auth Hero Terms of Service and Privacy Policy.
